Terms and Conditions of Use
Last updated: [07/11/2025]
1. Acceptance of Terms
By using the [Sparkle Wallet] app (“App”), the user agrees to
these Terms and Conditions. If you do not agree, please refrain
from using the App.
2. Description of the Service
The App is a non-custodial wallet that allows users to create
and manage a cryptocurrency wallet, maintaining full control
over their private keys.
The App allows users to purchase:
$ONE via an external third-party provider accessible through a
browser.
The App’s proprietary tokens (“Tokens”) via direct interaction
with a smart contract deployed on the blockchain.
•
The App does not hold user funds or keys and does not provide
financial intermediation or advisory services.
3. No Licensing or Registration
The company [SPARKLE WALLET LLC], developer of the
App, is not registered or authorized as a financial institution,
intermediary, or investment services provider with any
regulatory authority.
The user understands and agrees that the use of the App is
entirely at their own risk.
4. Risks and Responsibilities
• The user acknowledges the risks associated with
cryptocurrencies, including volatility, potential partial or
total loss, and vulnerability to human or technological
error.
• The company does not guarantee or ensure any profit,
value, or future availability of the purchased Tokens.
• The company cannot be held liable for any damages,
losses, or expenses resulting from the use of the App or
from the loss of private keys.
5. Interaction with Third-Party Providers
• Purchases of $ONE are made via third-party providers.
The company is not responsible for such transactions.
• The user is required to read and accept the third-party
providers’ terms and conditions before proceeding with
any transaction.
6. Lawful Use
The user agrees not to use the App for illegal purposes or in
violation of applicable laws, regulations, or rules, including
those relating to:
• money laundering,
• terrorist financing,
• international sanctions.
7. Intellectual Property
All rights related to the App, the [Sparkle Wallet] trademark,
and the source code belong to [SPARKLE WALLET LLC].
Any unauthorized reproduction or use is prohibited.
8. Limitation of Liability
To the fullest extent permitted by law, the company and its
affiliates shall not be liable for:
• App malfunctions,
• loss of access to the wallet or Tokens,
• indirect, special, or consequential damages.
9. Changes to the Terms
The company reserves the right to modify these Terms at any
time. Modifications will be effective from the date of
publication within the App or on the official website.
11. Internal Token Disclaimer
The “SPDU” and “HEUR” tokens are not available for
purchase or sale on the open market but are instead available
exclusively within the App. By “purchasing” these tokens, the
user is not participating in an ICO, as the company does not
hold reserves of such tokens.
When the user “purchases” tokens, they are interacting directly
with a smart contract deployed on the blockchain that
accumulates native cryptocurrency and issues tokens in return.
The company merely provides a technical interface to interact
with these smart contracts.
No returns or incentives (such as staking or redemption of
future company assets) are promised.
The user acknowledges that the company acts solely as a
technology provider and not as a financial entity.
11.1
The Sparkle Wallet platform provides only a software tool that
enables users to interact with decentralized smart contracts
deployed on public blockchains.
11.2
SPARKLE WALLET LLC is not involved in the fundraising,
purchase, or sale of tokens, nor does it hold or distribute tokens
on its own behalf or on behalf of third parties.
11.3
The smart contracts used by users are independent from
SPARKLE WALLET LLC and are operated via automated
mechanisms of the blockchain.
11.4
The use of the platform does not constitute an offer or
solicitation to invest in tokens or any other financial
instruments. SPARKLE WALLET LLC does not provide
financial advice, make promises of returns or benefits from
holding tokens, nor does it incentivize token purchases or
holdings.
11.5
Users are solely responsible for their decisions when
interacting with smart contracts, including any losses or
damages resulting from those operations. Users are strongly
advised to consult a legal and financial professional before
engaging in any cryptocurrency or token-related activity.
12. Platform Use
By using the platform, the user confirms that they understand
and accept the risks associated with blockchain technologies.
